{"id":4278,"date":"2022-07-06T11:30:47","date_gmt":"2022-07-06T09:30:47","guid":{"rendered":"https:\/\/gcebollero.com\/?p=4278"},"modified":"2022-07-06T11:49:15","modified_gmt":"2022-07-06T09:49:15","slug":"acomiadament-disciplinari","status":"publish","type":"post","link":"https:\/\/gcebollero.com\/ca\/acomiadament-disciplinari\/","title":{"rendered":"Acomiadament  disciplinari"},"content":{"rendered":"<h3><strong>Acomiadament\u00a0 disciplinari, exemple d\u2019una sent\u00e8ncia recent.<\/strong><\/h3>\n<p>&nbsp;<\/p>\n<h5>L&#8217;empresari no pot posar un detectiu al treballador quan s\u00f3n la m\u00fatua i la Inspecci\u00f3 els competents per al seguiment.<\/h5>\n<p>&nbsp;<\/p>\n<p>Acudir a la platja, passejar amb el gos o conduir una motocicleta &#8220;no revelen una activitat que sigui contr\u00e0ria a una malaltia f\u00edsica d&#8217;un treballador que ve objectivada per proves diagn\u00f2stiques&#8221;. Aix\u00ed ho considera la magistrada del Jutjat Social 4 de Gij\u00f3n en una sent\u00e8ncia favorable a un comercial d&#8217;una empresa de compravenda i reparaci\u00f3 de vehicles que es trobava de baixa m\u00e8dica quan va rebre la carta per acomiadament disciplinari. Ara l&#8217;empresa <strong>est\u00e0 obligada a readmetre&#8217;l o indemnitzar-lo amb prop de 58.000 euros.<br \/>\n<\/strong><br \/>\nDurant la seva incapacitat temporal, incl\u00f2s un ingr\u00e9s hospitalari, el treballador va rebre de la seva empresa una carta comunicant-li l&#8217;acomiadament disciplinari per una falta molt greu consistent a la transgressi\u00f3 de la bona fe contractual de l&#8217;article 54 de l&#8217;Estatut dels Treballadors i per simulaci\u00f3 de malaltia o accident.<\/p>\n<p>Pr\u00e8viament, l&#8217;empresa va requerir al treballador amb 20 anys treballant al concessionari que acud\u00eds a la fira de mostres malgrat la baixa m\u00e8dica.
